Privacy Policy

This Privacy Policy explains how Digital Marketplace LLC (“Digital Marketplace,” “DMP,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit digimarketplace.net (the “Site”), contact us, submit a form, or otherwise interact with our services (collectively, the “Services”). We are a company based in the United States that also provides services to clients in Canada, Europe, and Latin America.

Summary: We collect the information you give us (like your name, email, and phone number) and some data collected automatically (like cookies). We use it to respond to you, provide our services, and — only with your permission — send you marketing by email, text message (SMS), phone, or WhatsApp. You can opt out at any time. See Your Rights for how to access or delete your data.

1. Who this policy applies to

This policy applies to visitors, leads, and clients worldwide. Depending on where you live, additional rights may apply to you under laws such as the California Consumer Privacy Act as amended by the CPRA (“CCPA”), other U.S. state privacy laws, the EU/UK General Data Protection Regulation (“GDPR”), and Canada’s PIPEDA. Region-specific rights are described in Sections 8–10.

2. Information we collect

2.1 Information you provide to us

  • Contact and identity data: name, email address, phone number, company name, and any other details you enter into our forms, chat widget, or send us directly.
  • Communications: the content of messages, emails, chats, call notes, and support requests.
  • Marketing preferences: the consents you give (email, SMS, phone, WhatsApp) and any opt-outs.
  • Transaction data: if you become a client, billing details and service information (payment card data is processed by our payment processor, not stored by us).

2.2 Information collected automatically

  • Device and usage data: IP address, browser type, device identifiers, pages viewed, referring URLs, and timestamps.
  • Cookies and similar technologies: see Section 7. Non-essential cookies are only set after you consent through our cookie banner.

2.3 Information from third parties

We may receive information from analytics providers, advertising platforms, our CRM (GoHighLevel), lead-verification tools, and publicly available sources, consistent with applicable law.

We do not knowingly collect information from children under 13 (or under 16 in the EU/UK). If you believe a child provided us data, contact us at contact@digimarketplace.net and we will delete it.

SMS & phone consent (U.S. — TCPA). By providing your phone number and checking the marketing consent box on our forms, you agree that Digital Marketplace and its agents may contact you at that number with marketing and informational calls and text messages (SMS/MMS), including via automated technology or prerecorded/artificial voice. Consent is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Mobile opt-in information and phone numbers are never shared or sold to third parties or affiliates for their marketing purposes. Carriers are not liable for delayed or undelivered messages.

4. How we share your information

We do not sell your personal information for money. We share it only as follows:

  • Service providers / processors that act on our behalf: hosting, CRM (GoHighLevel), email/SMS/voice delivery, analytics, payment processing, and lead verification. They may only use the data to provide services to us.
  • Legal and safety: when required by law, subpoena, or to protect rights, safety, or property.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, with notice as required by law.

SMS/phone data is never shared with third parties for their own marketing. Some analytics or advertising cookies may involve “sharing” of online identifiers as defined under CCPA — see Section 8 to opt out.

5. Data retention

We keep personal information only as long as needed for the purposes described here, to comply with legal obligations, resolve disputes, and enforce agreements. Marketing contact data is retained until you opt out and for a reasonable period afterward to honor your opt-out. We keep records of consent (date, time, IP, and the consent language) as evidence of compliance.

6. Data security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Cookies and tracking

We use cookies and similar technologies for essential site functions, analytics, and marketing. Non-essential cookies are set only after you consent via our cookie banner, where you can accept or reject categories (Necessary, Analytics, Marketing) and change your choice at any time. You can also control cookies through your browser settings. We honor Global Privacy Control (GPC) signals as a valid opt-out of sale/sharing where required.

8. Your U.S. state privacy rights (California and others)

If you are a resident of California, or of another U.S. state with a comprehensive privacy law (e.g., Virginia, Colorado, Connecticut, Utah, Texas), you may have the right to:

  • Know / access the personal information we collect and how we use it;
  • Delete your personal information;
  • Correct inaccurate personal information;
  • Opt out of the “sale” or “sharing” of personal information and of targeted advertising;
  • Non-discrimination for exercising your rights.

Notice of collection: we collect the categories in Section 2 for the purposes in Section 3. We do not sell personal information for money and do not knowingly sell the data of anyone under 16.

Do Not Sell or Share My Personal Information: to opt out of cookie-based sharing for targeted advertising, adjust your choices in our cookie banner or enable Global Privacy Control. To submit any other request, email contact@digimarketplace.net with the subject “Privacy Request.” We will verify your identity and respond within the timeframe required by law (generally 45 days in California). You may use an authorized agent.

9. Your rights in the EU, UK, and EEA (GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the right to access, rectify, erase, restrict, or object to processing of your personal data, the right to data portability, and the right to withdraw consent at any time (without affecting prior processing). You may also lodge a complaint with your local supervisory authority.

Our legal bases are listed in Section 3. Where we rely on consent, you may withdraw it at any time by using an opt-out link, replying STOP, or contacting us.

International transfers: we are based in the United States, so your data may be transferred to and processed in the U.S. Where required, we rely on appropriate safeguards such as the EU Standard Contractual Clauses.

EU Representative (Art. 27 GDPR): We do not currently maintain an establishment in the European Union. If and when Article 27 applies to us, we will appoint a representative and update this section. In the meantime, EU/EEA and UK residents may contact us at contact@digimarketplace.net regarding their personal data.

10. Canada (PIPEDA / CASL)

For individuals in Canada, we obtain consent for the collection, use, and disclosure of personal information and for sending commercial electronic messages (email/SMS), consistent with PIPEDA and CASL. You may withdraw consent at any time.

11. How to opt out of marketing

  • Email: click “unsubscribe” in any marketing email, or email us.
  • SMS: reply STOP to any text message.
  • Phone: tell us on any call, or contact us to be added to our internal do-not-call list.
  • WhatsApp: reply STOP or block the number.

12. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version here and revise the “Last updated” date. Material changes will be communicated as required by law.
